The present application under Section 482 Cr.P.C. has been filed seeking to quash the entire proceedings of Case No. 1526 of 2019 (State Vs. Kunwarpal and others) u/s 147, 323, 452, 504, 506 I.P.C. pending in the court of the Additional Chief Judicial Magistrate-II, Badaun arising out of Case Crime No. 0203 of 2018 P.S. Islamnagar District Badaun and also to quash the charge sheet numbered as 250 of 2018 dated 15.10.2018 submitted in the aforesaid case.
Counsel for the applicants, after making submissions to some extent, fairly submits that the necessary ingredients for invocation of the powers under section 482 Cr.P.C. are not made out in the facts of the case. He accordingly submits that he does not wish to press the reliefs, as prayed for, in the application. The reliefs sought in the present application are therefore not entertained.
Counsel for the applicants states that the applicants would submit to the jurisdiction of the court below and apply for bail.
In case any such application is moved the court below would be expected to dispose it of in accordance with the settled principles of law.
Subject to the aforesaid observation the application stands dismissed.
