Heard learned counsel for the petitioner.
The instant petition has been seeking a direction to the Judge Small Causes Court No. 1 Kanpur Nagar to consider and decide SCC Suit No. 04 of 2016 (Shakilurrhman v. Mohd. Mehtab) as expeditiously as possible and preferably within a stipulated period.
Learned counsel for the petitioner submits that the petitioner is the landlord and the tenant-defendant is not paying rent of the property in dispute for which the petitioner has filed the aforesaid SCC Suit for arrears of rent in which notices has been served to the oppsoite party by way of publication and the written statement has also been filed. It is next submitted that the matter is at the stage of evidence.
After hearing the learned counsel for the petitioner and after perusing the material on record, this petition is disposed of with a direction to the Judge Small Causes Court No. 1 Kanpur Nagar to consider and decide SCC Suit No. 04 of 2016 (Shakilurrhman v. Mohd. Mehtab) expeditiously, without granting any unnecessary adjournment to either the parties and preferably within six months.
