Heard learned counsel for the petitioner and perused the material available on record.

By means of pres ent writ petition filed under Article 227 of Constitution of India, the petitioner has prayed for a direction upon the Civil Judge Senior Division, Mathura to decide SCC Suit No.27 of 2019 expeditiously as well as further direction to the court below to decide the said suit within a stipulated period as may be fixed by this Court.

It is submitted by learned counsel for the petitioner that petitioner is aged about 64 years and he is totally dependent upon the income of the rent of the shops in question. Learned counsel for the petitioner further submits that suit for ejection and for payment of balance amount of rent as well as damage is pending consideration before the Civil Judge Senior Division, Mathura since one and half years but no relief could be granted by the court below.

The writ petition is disposed off directing the Civil Judge Senior Division, Mathura to consider and decide the SCC Suit No.27 of 2019, expeditiously, in accordance with law, after affording notice and opportunity to all the parties, within a period of six months from the date of presentation of a copy of this order, if there is no other legal impediment. However, it is also expected that court below shall make every endeavour to expedite the hearing of the said case in accordance with law without granting unnecessary adjournment to either of the parties

It is made clear that this Court has not expressed any opinion on merits of the case and it is for the concerned authorities to decide the same in accordance with law. Order Date :- 22.10.2021 SY
