Heard Shri G.K. Singh, learned Senior Counsel assisted by Shri H.P. Sahi, learned counsel for the petitioners, learned Standing Counsel for the State-Respondent and Shri T.K. Mishra, learned counsel for the respondent No.7.

Present Writ Petition under Article 226 of the Constitution of India has been filed for quashing the election of the Committee of Management of the Institution held on 10.12.2019 wherein Shri R.K. Tiwari was elected as a Manager.

It is contended by learned counsel for the petitioners that the objection was filed by the petitioners against the said election held on 10.12.2019 and their objection be considered before the election was approved by the District Inspector of Schools and the signature of the elected Manager be attested.

Shri T.K. Mishra, learned counsel for the respondent No.7 has no objection in case the objection of the petitioners be considered before the approval of the election by the District Inspector of Schools.

Under these circumstances, direction is issued to the District Inspector of Schools, Sonbhadra, respondent No.5 to consider the objection of the petitioners dated 17.12.2019, appended as Annexure No.25 to the Writ Petition before taking the decision for approving the election in question and before attesting the signature of Shri R.K. Tiwari as a Manager after giving opportunity of hearing to the parties concerned as expeditiously as possible, preferably within a period of six weeks from the date of production of a certified copy of this order.

Writ Petition is, accordingly, disposed of.
