Heard Sri Prabhakar Awasthi, learned counsel for the petitioner and learned Standing Counsel.
The petitioner, who is the life member of general body of the college, known as Chaubisa Kanya Inter College, Mohana, District Bulandshahar filed this writ petition for the issuance of mandamus commanding the State Government to take into consideration the audit report and ensure the compliance of same in accordance with law within stipulated time.
It reflects from the record that the audit report dated 19.9.2013 pointed out certain financial irregularities by the management of the college and the said report was submitted by the Assistant Accounts Officer, Director of Education, U.P. at Allahabad dated 19.9.2013, but no action has been taken by the State Government pursuance to the audit report. Although several letters were sent in this regard by the authorities concerned to the State Government.
No useful purpose would be served by calling the counter affidavit or keeping the writ petition pending.
Under these circumstances, a direction is issued to respondent no.1-State Government to take proper consideration of audit report dated 19.9.2013 and ensure compliance, in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
