Heard Sri Awadhesh Kumar Malviya, learned counsel for the petitioner, learned Standing Counsel and Sri Dhananjay Awasthi, learned counsel for the respondent nos. 2 and 3.
Present writ petition has been filed for the issuance of writ of mandamus commanding the respondents to take decision with regard to grant recognition of the B.Ed course (2 units) in pursuance to the Clause 7 (16) of National Council for Teacher Education within stipulated time.
It is contended by learned counsel for the petitioner that petitioner applied for recognition in terms of Section 14/15 of NCTE Act, his application was processed and subsequently, the letter of intent dated 30.4.2015 was issued and some document was required to be submitted by the petitioner's institution in view of Regulation 7 (16) of NCTE Regulations, 2014. It is further contended by learned counsel for the petitioner that entire formality has been completed from the side of the petitioner on 7.3.2019 but no decision has been taken by the Committee with regard to matter for recognizing B.Ed course.
On the other hand, Sri Dhananjay Awasthi, learned counsel for the NCTE has no objection in case direction is issued to the respondent no.2-Director, National Council for Teacher Education, Northern Regional Committee to decide the same within stipulated time.
Under the facts and circumstances of the case, a direction is issued respondent no.3-Regional Director, National Council for Teacher Education, Northern Regional Committee to consider the petitioner's matter for recognition of B.Ed course (2 units), as expeditiously as possbile, in accordance with law, preferably within a period of three months from the date of production of certified copy of this order.
With the above direction, the writ petition stands disposed of.
