Heard learned counsel for the petitioners and Sri Ajeet Kumar Singh and Smt. Praveen Shukla, learned Standing Counsel for the respondents no.1 to 3.

After some arguments learned counsel for the petitioners confined his prayer only to the extent to direct the respondent no.2/District Magistrate/Collector, Bhadohi, District Bhadohi to decide his representation dated 14.6.2019, copy of which is appended as annexure no.10 to the writ petition.

In paragraph 17 of the writ petition, it is stated by the learned counsel for the petitioner that due to party bandi in the village, the village pradhan has started digging in Gata No.540 and 675 with intention to make a pond on the aforesaid land.

In this view of the matter, with the consent of learned counsel for the parties and without entering into the merits of the case, the writ petition is disposed of permitting the petitioner to submit a fresh representation before the respondent no.2/District Magistrate/Collector, Bhadohi, District Bhadohi along-with copy of his earlier representation dated 14.6.2019 as well as certified copy of this order within a period of ten days from today. If such a representation is filed, the respondent No.2 will decide the same by passing appropriate speaking order on the same expeditiously and preferably within a period of four weeks thereafter, in accordance with law after hearing all the parties concerned.
