Petitioner claims that she is entitled to pension being the legal heir of the deceased employee. She claims that the competent court has issued a succession certificate in her favour.

Learned Standing Counsel contends that these are matters of fact which need to be determined by the competent authority since admittedly the deceased employee has two wives.

The petitioner may make an application before the respondent no. 3, Superintendent of Police, District Kasganj who shall pass a speaking order in regard to pension claim after giving an opportunity to all concerned parties including the first wife of the petitioner, within a period of six months from the date of production of a computer generated copy of this order, downloaded from the official website of the High Court Allahabad, along with a copy of representation. The computer generated copy of such order be self attested by the petitioners (party concerned) along with a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked. The Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.

It is clarified that in case the first wife and the legal heir do not appear then the concerned authority may proceed as per law.

The writ petition is disposed of.
