The petitioner is aggrieved by the rejection of his application for grant of Review Medical Board.

The criteria for conduct of the Review Medical Board has not been stated in the counter affidavit, nor was it brought to the notice of this Court by the learned Central Government Counsel. It thus appears that there is no certain, fair and transparent criteria for appeal to the Review Medical Board. The rejection of the application of the petitioner for Review Medical Board is arbitrary and illegal.

In such view of the matter this writ petition is disposed of with the following direction:

The respondents are directed to conduct the Review Medical Board within a period of two weeks from the date of production of a computer generated copy of this order, downloaded from the official website of the High Court Allahabad, along with a copy of representation. The computer generated copy of such order be self attested by the petitioners (party concerned) along with a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked. The Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.

It is further clarified that the Review Medical Board shall exercise its independent judgment and strictly adhere to the criteria for physical fitness prescribed by the Indian Army.
