This Public Interest Litigation has been filed for removal of encroachments from Gata No.261 situated at village Baghui Bujurg, Pargana & Tehsil Sadar, District Ghazipur which is a Gaon Sabha land.
Learned Standing Counsel has opposed the prayer and has stated that the petitioner has an efficacious alternative remedy of filing an application under section 67 of the U.P. Revenue Code, 2006.
Having heard learned counsel for the parties, the Court is of the view that if the petitioner moves an application under section 67 of the Code within a period of two weeks from today, the same shall be considered and decided within the period provided under Rule 67 of the U.P. Revenue Code Rules, 2016.
The petition is, accordingly, disposed of.
