The respondent-petitioner entered in the services of the respondents being appointed as Sub-Inspector (Civil Branch) in the year 1982. He was transferred to Local Intelligence Unit of Muzaffarnagar and being aggrieved by the same he preferred a petition for writ that came to be dismissed by the order dated 23.05.2003. Learned Single Judge set aside the order dated 26.08.2000 whereby the respondent-petitioner was transferred from Civil Police to the Intelligence Branch of the Police. Being aggrieved by the order dated 23.05.2003 the instant appeal is preferred. Suffice to state that no interim order was passed by the Single Bench staying the operation and effect of the directions given on 23.05.2003. It is disclosed that at the time of filing of the petition for writ the age of the respondentpetitioner was 42 years. The age of superannuation in the State of U.P. is 58 years. The respondent-petitioner during pendency of this appeal must have been retired from service on attaining the age of superannuation.
In view of above, we don't find any just reason to examine merits of the case. The appeal is, hence dismissed.
