This writ petition has been filed, under Article 226 of the Constitution of India, for quashing of FIR dated 2.11.2019 in Crime No.1238 of 2019, lodged by respondent no.3 against the petitioner for committing offence under Sections 376, 328 and 506 of IPC, Police Station Dadri, District Gautam Budh Nagar. Learned counsel for the petitioner submits that prosecutrix is a legally married wife of the petitioner and their marriage was solemnized on 22.11.2018. The said marriage was subsequently registered on 26.11.2018 and the couple was living happy married life till the prosecutrix was taken away by her parents on 28.5.2019. Despite best efforts of the petitioner, parents of prosecutrix have not allowed her to return back with the petitioner and left with no other option, on 22.8.2019 the petitioner filed an application under Section 9 of the Hindu Marriage Act and the said application is still pending. On 24.10.2019, the petitioner filed a complaint under Section 156 (3) of Cr PC against the brother, aunt and uncle of prosecutrix for abduction of prosecutrix. He submits that prosecutrix appears to have been compelled by her parents, as a result of which present FIR has been lodged by her alleging commission of rape.
