Sri Vipin Kumar Singh, learned counsel for the petitioners, Sri J.K. Upadhyay, learned counsel for the State and Sri Mahendra Pratap Singh, learned counsel for the complainant.
Learned counsel for the petitioners, at the outset, wants to withdraw this petition with liberty to file appropriate application seeking anticipatory bail before the trial Court. He submits that the trial Court be directed to decide the anticipatory bail application expeditiously, preferably on the same day. He further submits that the Registry be directed to return certified copy of the impugned FIR.
Learned State Counsel and learned counsel for the complainant have no objection to this proposition.
Petition is, accordingly, dismissed, as withdrawn, with the aforesaid liberty.
Needless to state that in the eventuality of filing anticipatory bail application by the petitioners before the trial Court, the trial Court shall decide the same expeditiously in accordance with law considering all aspects of the case.
Registry is directed to return certified copy of impugned FIR to the petitioners after accepting xerox of the same.
