Heard Sri Anurag Pandey, learned counsel holding brief of Sri Sudarshan Singh, learned counsel for the applicant and learned AGA for the State.
A first information report was lodged as Case Crime No. 176 of 2020 at Police Station- Syedraja, District- Chandauli on 17.09.2020, under Sections 3/5A/8, 5B, under Section Cow Slaughter Act and Section 11 Prevention of Cruelty against Animals Act and Sections 411, 413, 414, 429 IPC.
The bail application of the applicant was rejected by learned Additional District Judge-II, Chandauli on 20.10.2020.
The applicant is in jail since 17.09.2020 pursuant to the said F.I.R.
Sri Anurag Pandey, learned counsel holding brief of Sri Sudarshan Singh, learned counsel for the applicant contends that the applicant was not named in the FIR. False recovery has been shown from the applicant. There is no independent witness of the recovery.
Learned A.G.A. has opposed the bail application.
