Heard Sri Ashwani Kumar Pathak, learned counsel for the applicant and learned AGA for the State.
A first information report was lodged as Case Crime No. 352 of 2017 at Police Station- Gagha, District- Gorakhpur on 17.10.2017, under Sections 147, 323, 504, 352, 427, 394, IPC.
The bail application of the applicant was rejected by learned Additional District & Sessions Judge/Special Judge (E.C. Act), Gorakhpur on 21.10.2020.
The applicant is in jail since 29.09.2020 pursuant to the said F.I.R.
Sri Ashwani Kumar Pathak, learned counsel contends that the applicant has been falsely implicated in the present case. False recovery has been shown from the applicant. There is no independent witness of the recovery. The applicant claims parity with the case of other co-accused who have been granted bail by this court. All the co-accused have been granted bail by this court as stated in para 15 of the application.
