Heard learned counsel for the petitioner, Sri Gopal Chandra Saxena, learned Standing Counsel for the Staterespondents and Sri Neeraj Dube, learned counsel representing respondent no.2-National Highways Authority of India.

By order dated 10th January, 2019, learned counsel for the respondents were granted time to obtain instructions in the matter.

Today both the learned counsel for the respondents have stated that instructions have not been received as such they have prayed for further time.

However, from a perusal of the record, we find that the claim of the petitioner with regard to payment of compensation for the constructions standing on the land acquired is pending consideration before the Special Land Acquisition Officer/Competent Authority (Sayunkt Sangathan), Bijnor. In this respect, the petitioner has also given a representation dated 24.09.2018 (Annexure-5 to the writ petition), which is said to be still pending. Learned counsel for the petitioner has also referred to communication dated 22.04.2017 filed as Annexure-2 to

the writ petition issued by the Competent Authority, whereby the value of the constructions has already been determined.

In view of the above, we do not deem it fit and proper to keep the petition pending rather disposed it of with a direction to Competent Authority to take an appropriate decision.

Accordingly, we dispose of this petition with a direction to respondent no.4, Special Land Acquisition Officer/Competent Authority (Sayunkt Sangathan), Bijnor to take an appropriate decision on the pending request of the petitioner, referred to above, strictly in accordance with law within a period of six weeks from the date of production of a certified copy of this order.
