Heard Sri Chetan Chatterjee, learned counsel for the petitioner, Sri Ravindra Singh, learned counsel for respondent no. 2 and 3 and learned Standing Counsel for the State.

Petitioner is admittedly a Sugar Cane Grower. His agricultural land is within the cane purchase centre 3/Chaperchidi, Saharanpur. Petitioner's earlier purchase center is at Islam Nagar. He has filed representation dated 15.10.2018 before the Deputy Cane Commissioner praying that his purchase centre should remain at Islam Nagar instead of Chaperchidi and he should be directed to decide the same. In this regard learned counsel for the petitioner submitted that Rule 5 (5) of U.P. Sugarcane Supply and Purchase Order, 1954 (hereinafter referred to as "Order, 1954") provides equitable disbursement of purchase centre whenever dispute in this regard, as per Sub-Rule 5(5) of Order 1954 that the representation determined by the sugarcane grower.

In view thereof, we dispose of this writ petition finally without expressing any opinion on merits of the matter directing concerned authority to take a final decision on petitioner's representation dated 15.10.2018, expeditiously, as in any case, within one month from the date of production of certified copy of this order.
