Heard learned counsel for the petitioner and learned Standing Counsel for the respondent no.1.

This writ petition has been filed for issuance of mandamus commanding the respondent no.2 to refund the admission fee of Rs. 1,89,000/- in B.Tech course at Galgotia University, Greater NOIDA, District Gautam Budh Nagar, Session 2014-15 within stipulated time.

The contention of learned counsel for the petitioner is that the petitioner has qualified the JEE Mains Exam-2014 and after counselling, Galgotia University, Greater NOIDA was allotted for pursuing B.Tech course for the academic session 2014-15. Thereafter, the petitioner has taken admission and deposited the admission fees amounting to Rs. 1,89,000/-. Due to some unavoidable circumstances, the petitioner could not pursue the course and filed a representation dated 15.03.2018 for refund of fees to the University. It is also on the record that University Grant Commission vide letter no. F10-1/2018 (CPP-I/PU) dated 05.02.2019 also requested the concerned University to examine the matter and refund the admission fee immediately as per the instruction issued by the Ministry of H.R.D/U.G.C. Copy of the instruction issued by the Ministry of H.R.D/U.G.C has also been sent to the University alongwith the letter, but no decision on the same has been taken by the respondent-University.

It is further contended by learned counsel for the petitioner that he also paid the hostel fee amounting to Rs. 70,000/-, which was also sought to be refunded vide letter dated 26.07.2019.

No useful purpose would be served by keeping this writ petition pending or for calling the counter affidavit by issuing notice to the concerned University.

The writ petition is finally disposed of with a direction to respondent no.2-Vice Chancellor, Galgotia University, Greater NOIDA, District Gautam Budh Nagar to examine the

petitioner's grievance as per the representation dated 05.11.2018 appended as annexure-3 at page 22-24 as well as representation dated 5.11.2018 appended as annexure-4 at page 25-26 to the writ petition by taking into consideration the letter dated 5.2.2019 issued by the University Grant Commission, New Delhi, as expeditiously as possible preferably within a period of one month from the date of production of certified copy of this order.
