Heard learned counsel for the petitioner and learned Standing Counsel for the respondent No.3.

In view of the order proposed to be passed, notices need not to be issued to the private respondents.

During the course of argument, learned counsel for the petitioner confined his prayer only to the extent that direction be given to court below to decide the recall/restoration application dated 28.11.2018 filed by the petitioner in Misc. Case No.24/2018 (Rajendra Prasad Dwivedi Vs. Sushila Devi and others) within a span of time.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid recall/restoration in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
