Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent Nos.1, 2 & 3.

For the order to be proposed, notice need not be issue to respondent No.4.

The petitioner has preferred with the following prayers:-

"[I] issue a writ, order or direction in the nature of mandamus commanding the respondent No.3 to decide the Case No.277 of 2016 (Bachchu Ram and others Vs. Vijay Laxmi) under Section 9 A (2) of the C.H. Act pending before him within stipulated period of time.

[ii] issue any other suitable writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.

[iii] To award cost of the petition to the petitioner." It is contended by learned counsel for the petitioner that Case No.277 of 2016 (Bachchu Ram and others Vs. Vijay Laxmi) under Section 9 A (2) of the C.H. Act was pending before respondent No.3/Consolidation Officer, Dumariyaganj, Siddharth Nagar since 2016 and prays for expeditious disposal of the case.

Learned Standing Counsel has no objection to the prayer made by petitioner.

Heard learned counsel for the parties present. With the consent of learned counsel for the parties present, the present writ petition is disposed of at the admission stage itself.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent No.3/Consolidation Officer, Dumariyaganj, Siddharth Nagar to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of one year from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
