After hearing learned Senior Advocate appearing for the petitioners at some length, it transpires that the controversy has in fact arisen out of a notification against which the writ petition was dismissed way-back on 12.8.1994, against which Special Leave Petition has also been dismissed, but the judgement by which the Notification for acquisition was up-held has not been annexed with the writ petition.
In our considered opinion, the said document is of vital importance to the controversy involved in the present case.
At this stage, Sri Rajesh Kumar Singh, learned counsel appearing for the petitioner submits that he may be permitted to withdraw the writ petition to file a better petition with better particulars annexing all the necessary documents.
Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.
