Heard Shri Shyam Murari Upadhyay, learned counsel for the petitioner, Shri U.K. Saxena, learned counsel for respondent no. 3 and learned standing counsel for the State - respondents.

The petitioner, in this writ petition, is seeking quashing of the order dated 25.02.2019 passed by the respondent no. 3; whereby, the Executive Engineer has determined the electricity assessment in respect of tubewell to be Rs. 3,01,146/-.

It is stated that the petitioner had, earlier, filed Writ C No. 29925 of 2018, which was disposed of by this Court vide order dated 05.09.2018 with a direction to the petitioner to approach the Executive Engineer within 10 days.

There is nothing on record to show that the petitioner approached the Executive Engineer concerned within 10 days and in fact, the objection, copy of which has been filed as Annexure No. 4 to the writ petition, referred to by the petitioner, was filed by him only on 05.03.2019, which shows that the petitioner has not complied with the order of this Court dated 05.09.2018. The impugned order further records that the petitioner did not appear before the authority.
