Heard learned counsel for the petitioner.

Learned Standing Counsel has accepted notices on behalf of respondents no.1 and 12.

In view of the order proposed to be passed, notices need not to be issued to the respondents no.2 to 11.

The petitioner has preferred the present writ petition with the following main prayer:-

" I. Issue a suitable order or direction to the Board of Revenue at Prayagraj to expeditiously decide the Revision No.34 of 2003-04 (Shanker Govind Rao Geth and others Vs. Sudhakar Rao Getha and others) pending before the Hon'ble Board of Revenue U.P. At Prayagraj within a short time bound period as may be determined by this Hon'ble Court under the facts and circumstances of the case. "

It is argued by learned counsel for the petitioner that a suit for declaration for bhumidhari rights under Section 176 of U.P. Zamindari Abolition and Land Reforms Act, 1950 was filed by him against the respondents. In the said suit an order was passed on 4.2.2004 by the Assistant Collector. Against the aforesaid order dated 4.2.2004 a revision was preferred by the petitioner before the Board of Revenue, U.P. at Prayagraj, which was numbered as Revision No.34 of 200304 (Shanker Govind Rao Geth and others Vs. Sudhakar Rao Getha and others). It is further argued that inspite of more than 15 years has already been lapsed till date no decision has been taken on the same.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to respondent no.1/Board of Revenue, U.P. at Prayagraj, to consider and decide the aforesaid revision in accordance with law expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
