Learned Standing Counsel has accepted notice on behalf of respondent no.1.
In view of the order proposed to be passed, notice need not to be issued to the respondent no.2.
The petitioner has preferred the present writ petition with the prayer to issue a mandamus directing the respondents authorities to consider the claim of the petitioner for grant of compassionate appointment under Dying-in-Harness Rules, 1974 in Town Polytechnic College, Ballia.
It is argued by Sri Ashok Kumar Pandey, learned counsel for the petitioner that father of the petitioner namely late Chandroday Upadhyay was working on the post of lecturer (Civil) in Town Polytechnic College, Ballia. He died during the course of his services on 27.7.2011. After his death representations were made by the petitioner for her appointment in place of her deceased father. It is further argued that although all the papers and documents as required in law was duly submitted by the petitioner before the authorities concerned but till date no decision has been taken on the same by the respondent no.1.
Heard learned counsel for the parties.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
Without entering into the merits of the case, the writ petition is disposed of permitting the petitioner to make a fresh representation ventilating all her grievances before the respondent no.1/Principal Secretary, Technical Education, Government of U.P., Lucknow, along with certified copy of this order within a period of three weeks from today annexing all the relevant papers and documents. If such a representation is filed, the respondent No.1 will pass appropriate orders on the same expeditiously and preferably within a period of two months thereafter.
