Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent nos.1 and 2 and Sri R.C. Upadhyay, learned counsel for respondent No.3.

It is argued by learned counsel for the petitioner that against the order dated 27.04.2019, an appeal was preferred by the petitioner in the Court of Settlement Officer Consolidation, Azamgarh as provided under Section 11(1) of the U.P. Consolidation of Holdings Act, 1953. Along with the memo of appeal, an application for grant of interim injunction was also filed by him on 08.05.2019.

It is argued by learned counsel for the petitioner that various dates were fixed on the aforesaid application for grant of interim injunction but no orders have been passed on the same. It is further prayed that the appeal filed by the petitioner be also directed to be decided expeditiously.

Heard learned counsel for the parties.

With the consent of learned counsel for the parties and without expressing any opinion on merits of the case with regard to the facts and circumstances of the case, the present writ petition is disposed of finally permitting the petitioner to submit an application before respondent No.1/ along with certified copy of this order within two weeks from today. If such an application is filed, respondent No.2 will consider and decide the stay application within one month from date of filing of the

same. It is further directed to the respondent No.1 to decide the appeal on merits within a period of one year but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
