Heard learned counsel for the petitioner and Sri Vikram Bahadur Yadav learned Standing Counsel.
The only issue which has been raised in this petition is for the grant of minimum in the pay scale to the petitioner who is engaged in the Department of Forest.
From the counter affidavit filed in these proceedings, the Court notes that the respondents take the position in paragraph-22 thereof that the petitioner has worked since July 2013 till date. This affidavit was affirmed on 25 August 2017.
In view of the above, learned Standing Counsel states that subject to verification of continued working of the petitioner as on date, the claim for grant of minimum in the pay scale shall be duly attended to and disposed of in accordance with law and bearing in mind the decision of the Supreme Court in Sabha Shanker Dube Vs. Divisional Forest Officer and Others Civil Appeal No. 10956 of 201.
Accordingly and without going into the merits of the claim of the petitioner, this petition shall stand disposed of in light of the statement noted above.
