Heard Sri Anant Vijay, learned Counsel for the petitioner, Miss. Sweety Kanojiya holding brief of Miss. Pooja Agrawal, learned counsel for Respondent Nos. 1 to 5 and Sri Salil Mohan, learned counsel for Respondent Nos. 6 and 7.

The petitioner was working as Assistant Teacher in Army Public School, Jhansi. Her services have been terminated by the order of Disciplinary Committee dated 28th June, 2019. The petitioner against the order dated 28th June, 2019 has preferred statutory appeal under Rule and Regulation 172 (c) of Army Public Schools before the Respondent No.2, the Chairman Board of Administration, Headquarter Southern Command, Pune.

Learned counsel for the respondents submits that since the appeal preferred by the petitioner is pending before the Respondent No.2, against the termination order dated 28th June, 2019, the writ petition is not maintainable.

Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with a direction to the Respondent No. 2, the Chairman Board

of Administration, Headquarter Southern Command, Pune to look into the matter and decide the appeal of the petitioner by reasoned and speaking order within a period of two months from the date of presentation of a certified copy of this order after giving opportunity of hearing to the petitioner.

With the aforesaid observations, the writ petition is disposed of.
