Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent no. 1 and Sri Pranesh Dutt Tripathi, learned counsel appearing on behalf of respondent nos. 2 and 3.

It is argued by learned counsel for the petitioner that the petitioner is entitled for salary for the post of Head Master due to the reason that she is discharging her duties on the aforesaid post. It is further argued that wholly, illegally respondents are making payment of salary to the petitioner on the post of Assistant Teacher. Learned counsel for the petitioner also relied upon the judgment delivered by the Division Bench of this Court in Special Appeal Defective No. 193 of 2017(Chandrabhan Yadav And 43 Others vs. State of U.P. And 6 Others) dated 03.04.2017. It is argued that the petitioner has already joined her duties on the post of Head Master on 10.07.2015 as such she is entitled for the payment of her salary on the post of Head Mistress. In this regard a representation was also made by the petitioner before the District Basic Education Officer, District Mau/respondent no. 3, copy of which is appended as Annexure-10 to the writ petition.

Heard learned counsel for the parties.

With the consent of learned counsel for the parties, the present writ petition is being disposed of finally at the admission stage itself.

In view of the above, without entering in to the merits of the case, the present writ petition is disposed of with liberty to the petitioner to file a fresh comprehensive representation ventilating all her grievances before the respondent no. 3/District Basic Education Officer, Mau within a period of three weeks from today along with certified copy of this order and in case any such representation is filed by the petitioner before the respondent no. 3 within the time indicated hereinabove, he shall consider and decide the same strictly in accordance with law by

a speaking and reasoned order as expeditiously as possible preferably within a period of one month from the date of filing of such representation by the petitioner before him.
