Heard learned counsel for the petitioner, learned Standing Counsel for respondents no.1 & 4 and Sri Anil Kumar Singh, learned counsel for the respondent no.2.

The petitioner has been selected by the respondent no.2-U.P. Secondary Education Service Selection Board, Prayagraj to be appointed as Assistant Teacher on 24.01.2019. The District Inspector of Schools-fourth respondent vide letter dated 13.03.2019 directed the Manager of the College to allow the petitioner to join in the College.

In response to the said letter of the fourth respondent dated 13.03.2019, the Manager of the College wrote a letter to the fourth respondent that one Amar Singh is already working on the said post under an interim order passed by this Court and thereafter, there is no vacant pot on which the petitioner could join.

The District Inspector of Schools on 11.09.2019, thereafter, wrote a letter to the Secretary, U.P. Secondary Eduction Service Selection Board, Prayagraj to take a decision in the case of the petitioner on account of non-issuance of appointment letter by the Manager of the College.

The petitioner submits that the Secretary of the Board has not taken any decision on the aforesaid letter of the respondent no.4. He further submits that he has submitted a representation to the Secretary of the Board on 25.09.2019 and 14.10.2019 but the same has not been considered by the Secretary of the Board till date.

Learned counsel for the respondent no.2 submits that at this stage, no useful purpose would be served in keeping the writ petition pending and an appropriate direction may be issued to the Secretary, U.P. Secondary Eduction Service Selection Board, Prayagraj to consider the grievance of the petitioner in

accordance with law.

Considering the facts and circumstances of the case and with the consent of the parties, the writ petition is disposed off with the direction to the Secretary, U.P. Secondary Eduction Service Selection Board, Prayagraj to consider the grievance of the petitioner and decide the representation of the petitioner preferably within a period of one month from the date of production of certified copy of this order by a reasoned and speaking order.

The writ petition is disposed off subject to observations aforesaid.
