Heard Sri Nipun Singh, learned counsel for the petitioner, Sri Avneesh Tripathi, learned counsel for respondent nos.2 and 3 and Sri H.N. Singh, learned Senior Counsel assisted by Sri Seemant Singh, for respondent no.4.
The petitioner in the present writ petition has challenged the order dated 29.07.2019 passed by the Vice Chancellor, Chaudhary Charan Singh University, Meerut whereby the Vice Chancellor has approved the election of committee of management, A.S.P.G. College, Mawana, Meerut respondent no.4.
Preliminary objection with regard to maintainability of the writ petition has been raised by the learned counsel for University contending that petitioner has statutory alternative remedy of reference under Section 68 of the State University Act and hence, the writ petition is not maintainable.
In view of the preliminary objection raised by the University, learned counsel for the petitioner submits that petitioner does not want to press the writ petition and wants to pursue his remedy before the Chancellor under Section 68 of the State University Act.
Accordingly, the writ petition is dismissed as not pressed.
