Heard learned counsel for the petitioner, learned Standing counsel for the respondents and perused the record.

The pubic interest litigation has been filed with the following prayer:-

(i) Issue a writ, order or direction in the nature of mandamus commanding the respondents to remove the illegal possession/encroachment over the pasture land bearing no.1945 situated at village Kumhiyanwa, Pargana Atharwan, Tehsil Manjhanpur, District Kaushambi.

(ii) Issue any other writ, order or direction, which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case, to which the petitioner may be found entitled in law.

(iii) Allow this writ petition with special costs in favour of the petitioner, throughout.

The grievance of the petitioner appears to be that the order passed under Section 67(1) of the U.P. Revenue Code, 2006 by which the encroachments made by private person on pasture land have been directed to be removed is not being implemented.

Section 67(3) empowers the Assistant Collector of the District to remove the encroachments if necessary by applying force.

In view of the above, we dispose of this PIL with liberty to the petitioner to move an application before the Assistant Collector concerned under Section 67(3) of U.P. Revenue Code, 2006.
