Heard learned counsel for the parties and perused the material available on record.

This special appeal is directed against the judgement and order dated 31.10.2012 passed by learned Single Judge dismissing Writ - A No. 54250 of 2012 filed by the appellants with the prayer to issue a writ, order or direction in the nature of certiorari quashing the order dated 31.10.2012 which was impugned by the appellants before the learned Single Judge on the ground that various papers in relation to the affairs of the institution were lying with respondent no. 5 Jeeut Ram.

However, respondent no. 5 Jeeut Ram placed before the learned Single Judge material indicating that he had supplied the entire list of documents to the Manager and copy of the list of documents had also been handed over to Sri Radha Kant Ojha, learned Senior Advocate, appearing along with Sri Gautam Baghel, for the appellants.

At the time of hearing of the appeal, learned counsel for the appellants had insisted that the entire papers have not been handed over by respondent no. 5 Jeeut Ram. However, keeping in view the categorical statement of fact made on behalf of respondent no. 5 Jeeut Ram that he did not have any paper and his claim that the entire papers were with the other group of management and the appellants had themselves asked respondent no. 5 Jeeut Ram to lodge First Information Report against them and unnecessarily, the papers were being demanded from him, whereas the fact of the matter was that the same were lying with the rival group of management with whom the appellants were litigating. The learned Single Judge dismissed the writ petition.

We have perused the impugned judgement and order and we do not find any reason to interfere with the same as the same is based upon relevant considerations and supported by cogent reasons.

The appeal lacks merit and is accordingly dismissed.
