The Vakalatnama filed by Sri Ajay Kumar Pathak, Advocate annexing therewith a copy of I.D. proof and a short counter affidavit annexing therewith copies of judgement and compromise deed filed by Sri Anuraj Shukla, learned counsel for opposite party no. 2, are taken on record.

Submission of learned counsel for the revisionist is that the parties have entered into amicable settlement and compromise deed has been filed before the trial court and the same is pending.

From perusal of order sheet and record, it appears that it is a revision of the year 2004 and it is still awaiting admission. It also appears that vide order dated 23.3.2004, the impugned order dated 16.12.2003 was stayed by this Court.

Both the sides have stated before the Court that amicable settlement has taken place and a copy of compromise deed has been filed today along with short counter affidavit, which is pending for consideration before the trial court. As such, it has been stated that revision may be dismissed as withdrawn and a direction may be given to the trial court for ensuring expeditious disposal of case in accordance with law and also to consider the compromise filed by the parties.

In view of above, revision is dismissed as withdrawn. Stay order, if any, stands vacated.

Looking to the facts and circumstances of the case, learned trial court is directed to expedite disposal of compromise pending before it in accordance with law.

It is also observed that if the revisionist-Ramesh Chandra Sharma appears and applies before the court below for bail within thirty days from today in Case Crime No. 2141 of 2003, under sections 420, 467, 468 IPC, P.S. Sasni, District Aligarh, Mahamaya Nagar, his bail application shall be disposed of

expeditiously in accordance with law preferably on the same day keeping in view that both the parties have entered into amicable settlement and compromise deed has been filed before the court.

For the above thirty days and no more, no coercive action shall be taken against the revisionist.
