Heard learned counsel for the applicant and Shri Kunwar Tejendra Bahadur, learned State Law Officer.

The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for wilful disobedience of the order dated 9.4.2013 passed by the Division Bench of this Court in Writ Petition No.10815 of 2013 (Mewa Ram v. State of U.P. & Ors.).

In compliance of the writ Court order, affidavits of compliance dated 27.3.2014 have been filed by the opposite parties annexing therewith the report dated 26.3.2014 as Annexure No.3 to the affidavit, stating therein that encroachment over Gata No.116 area 0.150 hect., which is in the form of 'pond' has been removed and the pond has been restored in its original form and the relevant photographs have also been appended.

The Court has proceeded to examine the record in question and is of the considered opinion that substantial compliance has been made of the writ Court order by the opposite parties. However, in case the applicant is still aggrieved, he is at liberty to invoke the remedy as is available under Section 67 of the U.P. Revenue Code, 2006.

The contempt application stands disposed of accordingly. Notices, if any, stand discharged.
