Learned counsel for applicants contended that applicants have been falsely implicated; that as per averments made in F.I.R. lodged by Kumari Jyoti on 6.11.2018 at 8:16 p.m. against applicants and other members of their family, at about 2:20 p.m. on 6.11.2018 she was present at home when over dispute of land of plot (Chabutra) neighbours applicants and 06 others armed with lathi-danda, bricks and stones came at the road infront of her house and after abusing her father, sister, brother, mother and first informant, committed marpeet and when her mother after getting rid of accused persons went towards BARHA (courtyard), accused persons went there, poured kerosene on her mother and put her on fire, by which she sustained deep burn injuries, was sent to C.H.C. Moth, after informing at Dial No.100 and died due to above burn injuries while first informant, her father, brother and sister also sustained injuries; that upon investigation charge sheet was submitted under sections 147, 148, 306, 323 and 504 IPC against accused persons; that entire prosecution story is absolutely false and incorrect; that following alleged dispute over land of plot (Chabutra) applicants neither poured kerosene on deceased nor caused any abetment in her mind for committing suicide; that injuries of injured persons are neither grievous nor on vital parts of their bodies, which may be considered to be dangerous to their lives; that applicant nos.1 to 3 are real brothers and applicant no.4 is son of applicant no.1 and they have been falsely implicated due to enmity on account of property dispute with regard to plot (Chabutra) ; that coaccused Smt. Malti (wife of applicant No.2) has been granted bail by another Bench of this Court vide order dated 14.2.2019 passed in Criminal Misc.
