It is submitted by learned counsel for the applicant that the applicant is languishing in jail since 21.2.2019(near about five and half months) having no criminal history. Co-accused namely Narain Singh has already been granted bail by this Court vide order dated 17.7.2019 in Criminal Misc. Bail Application No. 28343 of 2019, since the role of the applicant is not distinguishable with the role of co-accused, therefore, the applicant is also entitled for bail. He has been falsely implicated on the basis of suspicion due to previous enmity. After one month of incident, so-called independent witnesses namely, Kishan Singh and Amar Singh stated that they had seen accused persons including one Dharmo (servant of Dara Singh) committing the crime. Nobody had seen the incident. General role is alleged to have been assigned to all the accused. In case applicant is released on bail, he will not misuse the liberty of bail and will cooperate in the trial. It is also pointed out that coaccused,Dharmo and Ashok have been granted bail by coordinate Benches of this Court in Criminal Misc. Bail Application Nos. 30819 of 2019 and 30787 of 2019.
