Heard learned counsel for the applicant, learned A.G.A. appearing for the State and perused the record.
It has been contended by the learned counsel for the applicant that applicant has been falsely implicated in the present case. It is further submitted that the vehicle from which the good were recovered is not registered in the name of the applicant. It is also contended that name of the applicant has figured in the confessional statement of co-accused Ram Babu. It is next contended that applicant is a commission agent and hired vehicle from another person and give for transportation to another person. The matter needs deeper and fairer investigation before any arrest should be given effect to. Therefore, the applicant may be enlarged on anticipatory bail.
Learned A.G.A. opposed the prayer for bail.
Without expressing any opinion on the merits of the case, considering the nature of accusation and the fact that he has no criminal antecedents, the applicant is entitled to be released on anticipatory bail in this case.
