Heard learned counsel for the revisionist and Sri Rajesh Mishra, learned AGA for the State.
I have perused the earlier order dated 29.1.2018 passed by another Bench of this Court. Perusal of the said order shows that the present revision has already been dismissed. However, the matter was referred to the mediation centre with the following observation:-
"It is made clear that the Court has only accommodate the parties for mediating their dispute. The revisionist would adhere the judgment in its letter while paying the amount.
LIST THE MATTER IN THIRD WEEK OF MAY 2018 ALONG WITH THE REPORT FROM MEDIATION CENTRE. IT IS MADE CLEAR THAT SO FAR AS THE MERIT OF PRESENT REVISION IS CONCERN, ITS FATE HAS ALREADY BEEN SEALED. THE COURT HAS LISTED THE MATTER ONLY FOR THE PERUSAL OF MEDIATION REPORT. LIST THE MATTER IN THIRD WEEK OF MAY 2018."
Today when the case has been taken up, the Court has been informed that the mediation proceedings before the mediation centre could not be concluded in a settlement and the same has failed. I have perused the report of the mediation centre dated 4.4.2018 which shows that the mediation has completed but the parties could not arrive at any agreement.
Thus, keeping in view the earlier order dated 29.1.2018 passed by another Bench of this Court wherein the Court has categorically observed herein as under:-
"I do not find any good reason to interfere into the matter. I find that the present revision is devoid of merit.
Accordingly, the present criminal revision is dismissed."
Thus, in view of the aforesaid and in view of the report of the mediation centre dated 4.4.2018, no further adjudication is required.
The revision already stands dismissed.
