It has been argued by the learned counsel for the applicant that for the alleged incident dated 23rd May, 2019, the present first information report has been lodged on 1st June, 2019 by Chandrashekhar Singh Yadav i.e. uncle of the victim, namely, Kamini against the applicant i.e. after eight days from the date of incident for which no plausible explanation has been given which makes the prosecution case doubtful. In the first information report it has been alleged that on 23rd May, 2019 at 04:00 p.m. when the victim was grazing the goats in the field, then the applicant reached there and indicating indecent behaviour, he tore her clothes and also molested her, when the victim protested of the same, he threatened that if she shares the same to any one, he would kill her. She got a chance to run away and narrated entire story to the informant. It has further been argued by the learned counsel for the applicant that the entire prosecution story is wholly concocted. Except some variations, in both the statements recorded under Sections 161 and 164 Cr.P.C. the victim has reiterated the same version as unfolded in the first information report.
