It has been argued by the learned counsel for the applicant that for the alleged incident dated 14th May, 2019, the present first information report has been lodged on 19th May, 2019 by Sukhram Pal i.e. father of the victim, namely, Vishama Pal against three named accused persons including the applicant i.e. after five days from the date of incident for which no plausible explanation has been given which makes the prosecution case doubtful. In the first information report it has been alleged that on 14th May, 2019 at 11:30 p.m. (night), when the victim was sleeping at the roof of her house along with her sister and mother, the applicant came to her with the help of stair of another house of one Girdhari Lal and after closing her mouth, he started committing indecent act with the victim, she screamed, then wife of the informant woke up and she also shouted, on hearing the same, villagers came and caught the applicant. On information given by the informant, the Police came and arrested the applicant but on the next day of the incident he was released and nothing was done. On 15th May, 2019 at 03:00 p.m., the applicant along with his father, namely, Ramraj Pal and his mother came to the house of the informant and they threatened him to face dire consequences, if he does not withdraw the case, for which the present first information report has been lodged. It has further been argued by the learned counsel for the applicant that though the victim has reiterated the same version as unfolded in the first information report, but the whole prosecution story is wholly concocted.
