It is argued by the learned counsel for the applicants that earlier on 18.12.2016, an F.I.R. was lodged by the applicant-Rajeev Kumar against the complainant being Case Crime No. 611 of 2016, Under Sections 147, 148, 149, 307, 323, 504, 506 I.P.C. and 3(1)(X) SC/ST Act. As a counter blast, the present F.I.R. has been lodged against the applicant on the same day i.e. on 18.12.2016. Three persons were injured from the applicant's side, namely, Rajeev Kumar, Ravi Kumar and Amit and one from informant's side have sustained injuries. In the statement of the injured, the applicant-Rahul has been assigned the role of causing injury by country made pistol whereas others have assaulted by lathi , danda and saria, due to which he has sustained injuries. As per the injury report, there is fracture in left side parietal bone of the skull. It is further argued that the applicant-Rajaram is not named in the F.I.R. and for the first time, his name surfaced in the statement of witness, however, general role has been assigned to him. It is further argued that the co-accused-Balveer Singh has already been granted bail by this Court vide order dated 22.07.2019 passed in Cri. Misc. Bail Application No. 29095 of 2019, copy of which order has been passed on to the Court today, is kept on record. Accordingly, the applicants are also liable to be enlarged on bail.
