The submission of learned counsel for the applicant is that the applicant is quite innocent and has been falsely implicated in the present case with the ulterior motive. He submitted that the applicant is not named in the first information report. He submitted that nothing incriminating was recovered from the possession of the applicant or at the pointing out of the applicant. He submitted that the name of the applicant has surfaced during investigation in the statement of co-accused Gulshad @ Gulsher. He further submitted that the co-accused, who were arrested at the spot have been admitted to the concession of bail by another Bench of this Court by orders dated 08.02.2019, 05.03.2019, 08.03.2019, 04.04.2019 and 19.06.2019 passed in Criminal Misc. Bail Application Nos. 5739 of 2019 (Intzar @ Mota), 9322 of 2019 (Umar), 10131 of 2019 (Gulshad @ Gulsher), 14072 of 2019 (Islamuddin alias Islu) and 24758 of 2019 (Jullu @ Julfkar) respectively, copy whereof has been annexed on page nos.31 onwards of the paper book. He claims parity. He submitted that the applicant is in jail since 10.12.2018 and in case, he is released on bail he will not misuse the liberty of bail and will cooperate in the trial.
