The contention of the learned counsel for the applicant is that he has been falsely implicated in the present case by the police when he had gone to demand his money, which was taken by the defaulting company namely Rastriya Pashu, Avam Dairy Vikash Parishad, Prayagraj. He further submitted that he was not an employee of the company and he had also given Rs. 4 lacs to the defaulter company for getting job. He further submitted that when job was not given to the present applicant then he demanded his money and one of the director has returned one lac rupee to the present applicant by way of R.T.G.S. in his account and transaction of that account has been annexed on page 193 of the bail application. He further submitted that co-accused Vashistha has given cheque of Rs. 1 lac to the present applicant and cheque of Rs. 50,000/-, photocopy of those cheques have been annexed on pages 195-196 of the bail application. He further submitted that there is no evidence against him. He further submitted that in the middle of the FIR, it has been mentioned that Madan Kumar, Sharda Vinay, Ahmad, Ramesh Yadav, Suryabhan Chauhan, Ajay Kumar, Amit Kumar Shivhari, Arun Kumar, Vishal Singh and Dharmendra Kumar, they were shown as employee of the company and present applicant was not named amongst those employee. Lastly, he submitted that the applicant is languishing in jail since 11.4.2019 and in case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial.
