Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The present bail application has been filed by the applicant in Case Crime No. 756 of 2018, u/s 452, 302, 307, 120-B, 504, 506 IPC, P.S. Jani, District Meerut with the prayer for enlarging him on bail.
It is submitted by learned counsel for the applicant that the applicant has been falsely implicated in this case as he is real brother of main accused Vikendra @ Gauri to whom specific role of causing fire on the deceased has been attributed. It has been further argued that named accused Vikendra @ Gauri was in jail on the date of incident which makes prosecution version doubtful and he has also been granted bail in Bail Application no. 4169 of 2019 vide order dated 22.5.2019.
Learned A.G.A. has opposed the prayer for bail and submitted that 315 Bore Katta was recovered from the possession of the applicant. However he could not place any evidence against the applicant, which could be connected with the present case.
