Learned counsel for applicant contended that applicant has been falsely implicated for dowry death with general allegations being father-in-law of deceased; that as per averments made in F.I.R. lodged by Smt. Sugiya Devi on 23.11.2017, her daughter Sunaina was married to Ram Kewal Nishad about two and half years ago and since after marriage, she was being treated with cruelty for non fulfilment of demand of two wheeler motorcycle; that on 18.11.2017 Sunaina caught fire at the time of cooking food and was immediately taken to District Hospital, Deoria by her husband and applicant and upon being referred to Medical College, Gorakhpur she was taken by them to B.R.D. Medical College, Gorakhpur, where during treatment she breathed her last at 8:45 p.m.; that inquest report of deceased was prepared in presence of applicant as well as husband of deceased and first informant, mother of deceased amongst others; that applicant did not cause any burn injuries to deceased; that in any case burn injuries could have been sustained by deceased on account of dispute between husband and wife; that case of applicant is distinguishable from husband of deceased; that co-accused Phoolmati Devi, has been granted bail by another Bench of this Court vide order dated 9.7.2018 passed in Criminal Misc. Bail Application No.25270 of 2018, copy filed at Annexure No.6; that applicant has no criminal history; that applicant undertakes that he will not misuse liberty of bail; that applicant is in custody since 18.12.2018.
