Heard learned counsel for the applicant, learned A.G.A. and perused the record.
Learned counsel for the applicant contends that applicant has been falsely implicated; that applicant is not named in FIR lodged against eight persons for offence under Sections 328, 304, 272, 273, IPC and 60 Excise Act for selling contaminated illicit liquor resulting in death of certain persons; that without any evidence I.O. at the time of submitting charge sheet also named applicant as a person whose name came to light during investigation; that co-accused Neeraj Singh, Vinay Singh, Satish Mishra, Jitendra Trivedi and Alok Mishra alias Santosh Mishra with identical role have been granted bail by this Court vide orders dated 30.1.2019, 24.1.2019, 14.2.2019, 5.2.2019 & 24.1.2019 passed in Criminal Misc. Bail Application Nos.4377 of 2019, 1909 of 2019, 6472 of 2019, 4924 of 2019 & 2424 of 2019, copies of which have been produced for perusal and are taken on record; that applicant and co-accused persons have also been granted bail in connected Case Crime Nos.142 of 2018 and 143 of 2018, copies of which have been produced for perusal and are taken on record; that applicant has no criminal history; that applicant undertakes that he will not misuse the liberty of bail; that applicant is in custody since 20.5.2018.
