This application u/s 482 Cr.P.C. has been filed seeking the direction to the court below i.e. Juvenile Justice Board, Ghaziabad to decide Case no. 415 of 2012 (State vs. Naieem and another), Case Crime no. 812 of 2009, u/s 363, 366, 376 IPC, P.S. Loni, District Ghaziabad.
Heard applicants' counsel and learned A.G.A. for the State. Record has been perused.
It has been contended by counsel for the applicants that the applicants are juvenile in conflict with law and are facing trial in the aforesaid case since 2012; cognizance of the offence was taken against the applicants in the year 2009; certified copy of the ordersheet is appended as annexure-2 to the affidavit from which it appears that till date only doctor has been examined and bailable warrants have been issued against other witnesses yet no one turned up till date.
In the facts and circumstances of the case the Juvenile Justice Board, Ghaziabad is directed to adopt all coercive steps to secure their attendance in the trial and conclude the proceeding of the aforesaid case preferably within a period of six months from the date of production of the certified copy of the order.
With the aforesaid observation this application is disposed off.
