Heard learned counsel for the applicants, Sri Ashish Upadhyay, counsel for opposite party nos. 2 and 3 and learned AGA.
The present application u/s 482 Cr.P.C. has been filed for quashing the impugned charge-sheet dated 5.10.2019 in S.T. No. 101 of 2019 (State vs. Anup @ Nawal and others) arising out of Case Crime no. 0056 of 2019, u/s 366, 376, 363 IPC and Section 3/4 POCSO Act, P.S. Kotwali Konch, District Jalaun.
After hearing counsel for the applicants and after going through the statement u/s 164 Cr.P.C. of the victim, who is aged about 16 years in which she has not only levelled allegations of gang rape against the applicants but other two co-accused as well and has narrated entire episode how she was gang raped. Thereafter, counsel for the applicants states that he does not want to press the prayer for quashing the charge-sheet, therefore, the present application may be dismissed as withdrawn.
Accordingly, the present application is dismissed as withdrawn without any liberty to file fresh.
