Shri Somdev Dixit, learned counsel for the applicant and learned A.G.A are present.

This application has been given with the request to set aside the order of N.B.W issued by the learned trial court dated 07.03.2017 in Complaint Case No. 2484 of 2016 (Bhagwati Sharan Vs. Rambabu and others) under Sections 323, 379, 506 I.P.C, Police Station Bhogaon, District Mainpuri pending before J.M- Ist, Manipuri.

At the very outset the learned counsel has submitted that he wants some protection to avoid execution of the N.B.W issued by the trial court.

It appears that after more than two and half years from the date of order issuing N.B.W, this application has been given. There appears to be no explanation of the delay in the application, hence, the application is liable to be dismissed.

Application under Section 482 Cr.P.C is dismissed accordingly.

It is, however, observed that in case the applicants namely Ram Babu, Shiya Devi and Arvind Kumar appear before the court below within 30 days from today and gave application for setting aside of N.B.W, the same shall be considered by the learned trial court and shall be decided sympathetically, considering the allegation in the application that there was a compromise talk between both the sides and the applicants remained in confusion that the matter has ended.

For the above period of 30 days, no coercive measure shall be taken against the applicants in the aforesaid case. The said period shall not be extended in any manner, whatsoever.
