Learned counsel for the applicants has submitted that there was a civil dispute pending between the parties and the same was disposed of against the complainant/opposite party no. 2 and the decree passed therein was executed against him. By the said decree, he was dispossessed from the disputed premises. The opposite party no. 2, just to retaliate, filed a false complaint against the applicants making allegations to the effect that the applicants had committed maar-peet with him, pick up Rs. 2000/- from his pocket and certain papers were also taken away and are giving threatening also. It was further alleged that on 01.08.2015, the accused persons had beaten him very badly and he suffered serious injuries and his hand was fractured. An information was also given to the S.S.P., Ghaziabad. On 25.05.2016, the accused persons came and abused him and gave threatening with dire consequences and said that vacate the house otherwise the whole family will be burnt alive. Thus, the complaint was filed in respect of three incidents as alleged in the complaint. Thereafter, from perusal of the relevant papers attached with this application, it appears that in support of the allegation, the complainant got himself examined before the court below under Section 200 Cr.P.C. and he supported the complaint version. The statements of witnesses PW-1 Shamim Saifi and PW-2 Chand and both the witnesses also supported the version of the complaint.
